§ 2. Website, services and technical requirements
“Website” means kup4kola.pl and a “User” is any person who uses it. The Service Provider offers the following electronic services free of charge:
- access to content, including information about vehicles and the Service Provider’s services;
- searching and filtering published vehicle listings;
- indicative calculations using the finance calculator;
- sending an enquiry through the contact form;
- submitting a testimonial for review and possible publication on the Website.
The Website requires an Internet-connected device and a current browser supporting JavaScript; submitting a form also requires contact details through which a reply can be given. Internet use involves ordinary risks, including malware, phishing and unauthorised access, so Users should keep their software and device security up to date.
An agreement for an electronic service is formed when the User starts using the relevant function or successfully submits a form, and ends when that use or the handling of the submission is complete. The User may stop at any time. No account is required. These Terms do not govern a vehicle sale, rental, brokerage or financing transaction, whose terms are agreed separately.
§ 3. Rules of use
The User must use the Website lawfully, in accordance with good practice and for its intended purposes. In particular, Users must not:
- provide unlawful content or content that infringes third-party rights, personal rights or accepted standards of conduct;
- impersonate another person, knowingly provide false data, or send unsolicited advertising or spam;
- introduce malicious code, circumvent security or disrupt the Website;
- automatically download content in a way that places an excessive load on the Website.
The Service Provider may refuse to handle a request, restrict access or remove content to the extent necessary to remedy a breach, secure the Website or comply with a legal duty. Rights under mandatory law remain unaffected.
§ 4. Listings and finance calculator
Vehicle listings, prices and descriptions are for information only and, unless expressly stated otherwise, are invitations to enter into an agreement within the meaning of Article 71 of the Polish Civil Code, not binding offers. Submitting a form does not reserve a vehicle. Availability, equipment, condition, price and other terms are confirmed individually before contract, and identified errors are corrected without undue delay.
Calculator results are simulations based solely on the information entered by the User. They are not an offer of credit, leasing or other finance, financial advice or a credit decision. Final terms are set by the relevant finance provider after its required assessment.
§ 5. User testimonials
A testimonial may be submitted by an adult with full legal capacity. The author confirms that it describes their genuine experience, is lawful, does not infringe third-party rights and may be published.
On submission, the author grants the Service Provider a non-exclusive, royalty-free, worldwide licence for the publication period to digitally record, store and make the testimonial publicly available on the Website and its language versions. The author also permits translation and technical formatting that does not alter the meaning, and attribution using the supplied display name.
Testimonials are moderated before publication. The Service Provider may decline or remove one that breaches the law or these Terms, contains third-party data, advertising or spam, or does not concern a genuine experience or the Service Provider’s business. Publication does not confirm a purchase or every statement by the author.
The author may request an end to publication at any time by emailing biuro@kup4kola.pl. The licence ends when the testimonial is removed from the public Website, without affecting earlier lawful use or retention of a copy required by law or needed to protect claims.
§ 6. Complaints
Complaints about electronic services may be emailed to biuro@kup4kola.pl or posted to the Service Provider. The complaint should describe the issue and date, the requested outcome and details for a reply. Missing details do not cause rejection if the complaint can still be considered.
The Service Provider will respond to a consumer complaint on paper or another durable medium within 14 days of receipt. Other complaints will be considered without undue delay. Statutory rights remain unaffected.
If the dispute remains unresolved, the Service Provider will tell the consumer on a durable medium whether it agrees to the appropriate out-of-court procedure. Trade Inspection and municipal or district consumer ombudsmen may also assist; information is available at polubowne.uokik.gov.pl.
§ 7. Privacy and cookies
The processing of personal data is described in the Privacy Policy, and cookies and similar technologies are described in the Cookie Policy. Both documents are available free of charge on the Website.
§ 8. Final provisions
These Terms and the electronic services are governed by Polish law. This choice does not deprive a consumer of protection afforded by non-derogable provisions applicable in the country of their habitual residence. Court jurisdiction is determined by generally applicable law.
These Terms take effect on 17 August 2026.
